Privacy Policy

Last updated on February 18, 2026. This Privacy Policy is effective immediately for users accessing or using the Website and/or Services on or after February 18, 2026.

Learner Mobile® is a mobile application and online platform, www.learnermobile.com, admin.learnermobile.com, and app.learnermobile.com, (collectively the “Site”) provided by SVI, LLC (SVI, we or us). SVI is an Arkansas limited liability company that exists to provide users of the Site with an education and training resource (“Services”). This privacy policy (“Policy”) describes how SVI collects, uses, protects and shares personal information of users of the Site.

About SVI and our Privacy Policy

SVI understands how important privacy is to you and we are committed to creating a safe environment for learners of all ages.

A note about students: SVI may be may be used by institutions of higher learning and teachers (collectively referred to as “Schools”) in a classroom setting or through virtual learning. When SVI enters into a contract with Schools to provide the Service as part of the School’s educational curriculum, we will have limited access to personal information about students (“Student Users”). Please see the section entitled “Student Users” for information about what information we gather during the provision of the SVI Service to Schools.

What We Collect and How We Use It

We respect your information and our goal is to collect as little personal information as possible while still providing a quality service to you and your institution. We receive and store information about individuals in a range of ways.

Information You Give Us. The majority of the information we collect is from your institution or organization when they create an account for you. The section below discusses that information.

We do collect information from accessing our Site, like when you fill out forms on our Site. The information we collect from you is used to potentially provide the Service to you and to fulfill any obligations from us or you in regards to the Service. This information includes records and copies of your correspondence with us and details of any transactions with us.

In some areas of our Site, we can ask for more input, like our AI products.  When you provide information to us in inputs, it may include personal information and we ask that you consider this and if it is necessary to the service you’re requesting from us before providing information to our AI products. 

Information from Other Users. When SVI enters into a contract with Schools or organizations to provide the Service, we collect information, including personal information, when your institution or organization creates an account to subscribe to our Services, to help us identify you, including your‎ name, your email address, your location, and potentially your employee identification number.

The information we collect from others is used to provide the Service to you and to fulfill our obligations to you or your institution or organization in regards to the Service. Specifically, that includes your records, providing customer service, communicating with you about your account, and to enforce compliance with our Terms of Use and applicable laws.

Information Automatically Collected. We automatically log information about you and your computer. For example, when visiting our Site, we log IP address, date and time of access, location information, browser information, operating system information and information about your use of and actions on our Site. While you use our site, we also collect information related to how you interact with us, such as your path through our Site or how long you interact with our Site. This information allows us to update our services and learn how we can better equip the Site to serve you.

Student Users and Student Records

When the Service is used as part of the School’s educational curriculum, SVI collects personally identifiable information from or about students or other information protected by similar student data privacy laws (“Student Records), which may include educational records governed by the the Family Educational Rights and Privacy Act (“FERPA”).  We consider Student Data to be strictly confidential and do not use such data for any purpose other than improving and providing our products and services to the educational institution or on the educational institution’s behalf. Our collection, use, and sharing of Student Data is governed by our contracts with the educational institutions, the provisions of FERPA, and other applicable laws that relate to the collection and use of Student Records.  If you are a student that has used our Service and have questions about reviewing, modifying, or deleting your Student Records, please contact your educational institution directly.

SVI Uses this Information in the Following Ways

Your institution or organization decides how we use the information we collect.  By providing our services to your organization or institution, we primarily use the information we collect to provide feedback and reporting.  This includes:

  • How you use the Site, like what pathways you use within the Site;
  • What you look at on the Site, including which learning objects you view and/or complete; and
  • What learning objects you complete on the Site, including your scores.

In addition to providing this feedback to your organization or institution, we may use the information we collect in the following ways:

To provide and enhance our Service. We provide our Services to end users of institutions and organizations as a data processor for those entities.  We use your information on behalf of and under the instruction of your institution or organization to operate, maintain, enhance, and provide all of the features of our Services.

To personalize your experience. We use the information to personalize your experience while using the Services. For instance, SVI remembers your recent activity so we can recommend the most appropriate content for you on your next visit and provide personalized learning experiences.

To communicate with you. We use your information to communicate with you about your account and respond to inquiries.

To understand, improve, and develop our Services. SVI uses all of the information that you provide or that we collect from users to understand and analyze the usage trends, learning behaviors, and preferences of our users, to improve the way the Services work and look, and to create new features and functionality.  When we use information for these purposes, we implement appropriate safeguards, including removing your personal identifiers like your name.

Sharing of Personal Information

The goal of SVI is to provide a learning management system for institutions and organizations to provide educational content to the users of the Site. Protection of your personal information is important to us.  We do not sell or trade your personal information with others. We do not share personal information with third parties for users of the site that do not have an account with SVI for Services.  If you have an account to access the Services, we may share information with institutions or organizations as follows:

  • We share your information in accordance with our agreement with your organization or institution.  Generally, this means we will share much of the personal information with your institution or organization. The information shared depends on the institution and organization.
  • We share your Student Record information in accordance with our agreement with your institution.  The information shared depends on the institution.
  • We may share personal information for legal, protection, and safety purposes. We may share information to comply with laws. We may share information to respond to lawful requests and legal processes. We may share information to protect the rights and property of SVI, our agents, customers, and others. This includes enforcing our agreements, policies, and terms of use. We may share information to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of SVI’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by SVI about our Users is among the assets transferred. We may share information in an emergency. This includes protecting the safety of our employees and agents, our customers, or any person.
  • We may share personal information – if you provide it in inputs – to third party AI providers to provide you Services at your request. For example, if you provide content for translation that includes personal information, this information will be transferred to Microsoft for translation services.

Third Party Payment Services

We rely on third parties to process credit card transactions and we do not store or collect your credit card details.  That information is provided directly to our third party payment processors and that collection is governed by their Privacy Policy. Currently, we use the service of Stripe, Inc. For more information on Stripe's privacy practices, please refer to their Privacy Policy. 

Information Choices and Changes

In some jurisdictions, you have rights to control how your personal information is used. You may have the right to request access to, change to, or erasure of personal information we hold about you. In the EU, you also may have the right to object to or restrict certain types of use of your personal information and request to receive a copy of the personal information you have provided to us. We will keep your information for as long as you have an account or as long as we need it to fulfill the purpose for which it was collected or disclosed to you at the time of collection. We may also keep some of your information as required to meet legal or regulatory requirements, resolve disputes, prevent fraud or abuse, enforce our Terms of Use, or for other permissible purposes. You may send requests about personal information to our Contact Information below or to support@learnermobile.com. If you are a user of our Services through an educational institution, contact your institution to exercise your rights. We will work with your institution to support your request. If you are a user of our Services through an organization, please email us at support@learnermobile.com. Once we receive and confirm your verifiable request, we will investigate and attempt to resolve complaints and disputes regarding use and disclosure of your information in accordance with this Privacy Policy.

Storage of Information

Your information collected through the Site is processed in the United States. If you are based in the United States and use our Site, you consent to have your information processed by SVI in the United States. International clients have differing needs based on their country of origin and we provide custom storage and processing solutions to meet those requirements.

The security of your information is important to us. We use commercially reasonable technical and organizational safeguards to protect your information from unauthorized use, disclosure, and loss.

We encourage you to take reasonable measures to protect your password and your computer to prevent unauthorized access to your account. Data transmission over the Internet, mobile networks, wireless transmission or electronic storage of information is a risk and cannot be 100% secure. As a result, we cannot guarantee or warrant the security of any information you transmit to or from our Site, and you provide us with your information at your own risk.

Children

SVI does not permit children under the age of 13 to create an account. Please contact us at support@learnermobile.com if you believe we have inadvertently collected personal information from a child under 13 so that we may delete the information as soon as possible.

Visitors from Outside of the United States

We mention above that the Site is hosted in the United States and our headquarters is in the United States. If you are visiting the Site from outside the United States, information we collect about you will be transferred to, stored and processed in the United States in accordance with this Policy and applicable U.S. laws. 

Please note that data protection and other applicable laws of the United States may differ from the data protection or consumer protection laws in your country. By using the Service, you acknowledge and consent to transfer of your information to our facilities as described in this Policy.

For our international customers, any questions or concerns regarding the collected information, use or disclosure of your information should be directed to support@learnermobile.com.  Once we receive and confirm your verifiable consumer request, we will investigate and attempt to resolve complaints and disputes regarding use and disclosure of your information in accordance with this Privacy Policy.

Privacy Rights for Certain State Residents

State laws in California, Colorado, Connecticut, Delaware, Iowa, Montana, New Hampshire, New Jersey, Oregon, Texas, Utah, and Virginia may provide you with additional rights regarding our use of your personal information. This section supplements our general Policy and applies to users in the states having additional consumer data rights.

Changes to Privacy Policy

The Services and our business may change from time to time. As a result, at times it may be necessary for SVI to make changes to this Privacy Policy. SVI reserves the right to update or modify this Privacy Policy at any time and from time to time. We will notify you by means of a notice on this Site of any material changes to this Privacy Policy. Your continued use of the Services after any changes or revisions to this Privacy Policy shall indicate your agreement with the terms of such revised Privacy Policy.

Privacy Rights for Residents of Specific States

This PRIVACY NOTICE for state-specific residents supplements the Privacy Policy of SVI, LLC (“SVI”) and applies solely to visitors, users and others who reside in California, Colorado, Connecticut, Delaware, Iowa, Montana, New Hampshire, New Jersey, Oregon, Texas, Utah, or Virginia (“you”) when you visit the SVI Learner Mobile website, www.learnermobile.com (the “Site”) or register for an account with Learner Mobile. 

Information We Collect

We collect information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device (“Personal Information”). In particular, we have collected the following categories of personal information from consumers within the last twelve (12) months:

  • Identifiers, such as Name, Internet Protocol address, email address, or other similar identifiers.
  • Internet or other similar network activity, such as Access history and information on your interaction with our Site.
  • Geolocation data, such as Location, but we do not collect precise location data as defined by state consumer data laws.

We obtain the categories of personal information listed above from the following categories of sources:

  • From your employer or educational institution. For example, through information provided by your organization to set up an account for you.
  • Directly and indirectly from you when using our Services or visiting our website. For example, usage details collected automatically in the course of your interaction with our Site.

Sensitive Information

We do not request or collect sensitive personal information as defined by the California Consumer Privacy Act or any other state privacy law.

Use of Personal Information

Your institution or organization decides how we use the information we collect.  By providing our services to your organization or institution, we primarily use the information we collect to provide feedback and reporting to that entity to fulfill our obligations to your educational institution or your employer.  This includes:

  • How you use the Site, like what pathways you use within the Site;
  • What you look at on the Site, including which learning objects you view and/or complete; and
  • What learning objects you complete on the Site, including your scores.

In addition to providing feedback and reporting, we may use or disclose the personal information we collect for one or more of the following business purposes:

  • To improve our Site.
  • As necessary or appropriate to protect the rights, property or safety of us, our customers or others.
  • To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.
  • As described to you when collecting your personal information.
  • To evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by us is among the assets transferred.

We will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice.

Sharing Personal Information

We may disclose your personal information to a third party for a business purpose. When we disclose personal information for a business purpose, we enter a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract.

In the preceding twelve (12) months, we have disclosed the following categories of personal information for a business purpose:

  • Identifiers, such as Name, Internet Protocol address, email address, or other similar identifiers.
  • Internet or other similar network activity, such as Access history and information on your interaction with our Site.
  • Geolocation data, such as Location, but we do not share precise location data as defined by state consumer data laws.

We only disclose your personal information for a business purpose to the organization or institution that created the account on your behalf. In the preceding twelve (12) months, we have not sold any personal information.

Your Rights and Choices

Your privacy choices are important to us and we would like to make sure you are fully aware of all of your data protection rights. Every user is entitled to the following:

The right to access – You have the right to request SVI disclose what personal information it collects, uses, discloses or sells. Once we receive and confirm your verifiable consumer request, we will disclose to you:

  • The categories of personal information we collected about you during the past 12 months.
  • Our business or commercial purpose for collecting that personal information.
  • The categories of third parties with whom we share that personal information.
  • The specific pieces of personal information we collected about you (also called a data portability request).

SVI does not sell your personal information for monetary compensation.  However, as described in this Privacy Policy, we may allow certain third parties, like your employer or organization, obtain your information so we can provide services to you.  Under some circumstances a transfer of personal information to a third party without monetary consideration may be considered a “sale” under California law.

The right to rectification – You have the right to request that SVI correct any information you believe is inaccurate. You also have the right to request SVI to complete the information you believe is incomplete. Our correction and completion of information is limited to personal data collected over the last 12 months and does not include information solely about equipment.

The right to data portability – You have the right to request that SVI transfer the personal information data that we have collected to directly to you under certain conditions.

The right to erasure – Some state residents also have the right to request the deletion of their personal information collected or maintained by SVI.  Once we receive a request for deletion and confirm your verifiable consumer request, we will delete the personal information (to the extent required by law) we hold about you as of the date of your request from our records. In some cases, deletion may be accomplished through de-identification of the information. If you choose to delete your personal information, you may not be able to use certain website functions that require your personal information to operate.

We may deny your deletion request if retaining the information is necessary for us or our service providers to:

  • Complete the transaction for which we collected the personal information or take actions reasonably anticipated within the context of our ongoing business relationship with you.
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  • Debug products to identify and repair errors that impair existing intended functionality.
  • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  • Comply with the state consumer data privacy laws.
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  • Comply with a legal obligation.
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Verifying Requests Access, Data Portability, and Deletion Rights

Only you or a person registered with your Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.  To help protect your privacy and maintain security, we will take steps to verify your identity before granting you access to your personal information or complying with your request. 

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative. In addition, if you ask us to provide you with specific pieces of personal information, we will require you to sign a declaration under penalty of perjury that you are the consumer whose personal information is the subject of the request. If you designate an authorized agent to make an access, deletion or opt-out of sale request on your behalf (a) we may require you to provide the authorized agent written permission to do so, and (b) for access and deletion requests, we may require you to verify your own identity directly with us.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.  Making a verifiable consumer request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

If you make a request, we have 45 days to respond to you. 

We will not discriminate against you for exercising your rights.  This means we will not deny you service, charge different prices or rates, provide a different level of service, or suggest that you might receive a different price or level of quality for service.   Please know, if you ask us to delete your information or stop transferring your information, it may impact your experience using our Site.
